January 2010

Bill Cowden, the former Chief of Asset Forfeiture at the United States Attorney's Office for the District of Columbia, and a Senior Trial Attorney with the United States Department of Justice, joins Mallon & McCool, LLC as partner.

• Joe Mallon negotiates a large, confidential settlement for a corporate executive who was denied a promotion based on race.

December 2009

• Following three-weeks of testimony at a hearing before the Honorable Ricardo M. Urbina in the United States District Court for the District of Columbia, Steven McCool obtained a dismissal of all charges against his client, Donald Ball, a former Blackwater security contractor. In a sweeping 90-page opinion, Judge Urbina found that Federal prosecutors and agents violated Mr. Ball’s Fifth Amendment rights and engaged in other misconduct.

• Steven McCool is recognized by Washingtonian Magazine as an elite criminal defense lawyer in the Washington, D.C. area.

Following substantial pretrial discovery, Marshall Perkins successfully settles Baltimore City medical malpractice and wrongful death action involving state-law medical negligence and EMTALA claims.

August 2009

• Joe Mallon convinces a Maryland medical institution to issue a written admission that it failed to follow administrative guidelines, and his physician client is awarded additional remedies following extensive appeals.

• Team of attorneys including Marshall Perkins secures preliminary settlement of shareholder class action arising out of Alpha Natural Resources, Inc.’s proposed acquisition of Foundation Coal Holdings, Inc., in the case Ascot Associates v. James F. Roberts, et al., Case No. 02-C-09-142316 (Circuit Court for Anne Arundel County).

• Joe Mallon convinces Louisiana Civil District Court to deny lead paint defendants’ efforts to compel production of documents protected by Louisiana medical peer review statutes, from third-party client, after motions practice and a contested hearing in New Orleans, Louisiana, in In re BHP Patriots Ltd., Partnership’s Request For Discovery, Civil Action No. 09-4257, E-7 (Civil District Court, Parish of Orleans, Louisiana).

May2009

• Joe Mallon wins disability discrimination trial, and his client is awarded $120,516.00.

• Joe Mallon settles sex discrimination case against a governmental agency for a significant monetary sum.

April 2009

• Steven McCool secures complete acquittal following the trial in D.C. Superior Court of a Georgetown University student charged with multiple counts of assault.

March 2009

• Joe Mallon obtains sizeable confidential settlement for client who alleged sexual harassment against a large, private corporation.

• Representing a Baltimore County volunteer fire department, Marshall Perkins wins a partial motion to dismiss in Purkey v. Violetville Volunteer Fire Dep’t, Case No. 03-C-08-005728 (Circuit Court for Baltimore County), terminating the case in the client’s favor.

December 2008

• Steven McCool is voted a Washington, D.C. Super Lawyer for White Collar – Criminal Defense.

November 2008

• Steven McCool obtains dismissal for U.S. Naval officer charged with aggravated assault. Following a preliminary hearing, a D.C. Superior Court magistrate judge agreed with Mr. McCool that there was no probable cause to arrest his client.

• Steven McCool secures a sentence significantly below the mandatory-minimum term of imprisonment for client charged with possession of prohibited images.

October 2008

• Steven McCool negotiates a sentence of probation in D.C. Superior Court for a client facing a mandatory-minimum term of imprisonment for driving while intoxicated.

September 2008

• Steven McCool obtains dismissal in the Circuit Court for Baltimore County Maryland for Towson State University student charged with burglary and other felonies.

• Steven McCool secures a sentence significantly below the Sentencing Guidelines range for former KPMG attorney charged with enticement in the U.S. District Court for the District of Columbia.

• Steven McCool secures a sentence of probation for client charged with violating the Foreign Corrupt Practices Act in the United States District Court for the District of New Jersey.

• Steven McCool represents clients before the Grand Jury in the District Columbia investigating violations of the Foreign Corrupt Practices Act in Afghanistan.

• Steven McCool wins jury trial in the U.S. District Court for the District of Columbia for a Vice President of a transportation consulting firm who was charged with honest services fraud by the Antitrust Division of the Department of Justice.

May 2008

• Steven McCool secures sentence of probation in the Circuit Court for Prince Georges County Maryland for University of Maryland student charges with possessing with the intent to distribute large amounts of marijuana and LSD.

April 2008

• Steven McCool negotiates a non-fraud plea for attorney charged in the U.S. District Court for the Eastern District of Virginia with immigration fraud and conspiracy and facing several years in prison and disbarment. This results in a 30-day jail sentence and a suspension of attorney’s law license rather than disbarment.

March 2008

• Steven McCool successfully moves for attorneys’ fees under the Civil Asset Forfeiture Reform Act of 2000 (“CAFRA”), after prevailing on a third-party petition, ancillary to a criminal forfeiture matter in the United States District Court for the Eastern Virginia. The district court’s decision in United States v. D’Esclavelles, 541 F. Supp.2d 794 (E.D. Va 2008) is the first reported decision awarding attorneys’ fees under CAFRA in a proceeding ancillary to a criminal forfeiture matter.

February 2008

• Steven McCool negotiates a highly favorable settlement for Canadian company under investigation by the U.S. Postal Services for allegedly using promotional activities and representations for obtaining money or property through the mails in violation of federal law.

• DC Superior Court judge orders arrest records sealed following acquittal obtained by Steven McCool at trial in assault case.
